Welcome to Bingomatic! These Terms of Service ("Terms") govern your access to and use of the Bingomatic website, bingo game rooms, standalone agent plugin, and any related services (collectively, the "Service"). The Service is provided by Bingomatic ("we," "us," or "Bingomatic").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

1. Acceptance of Terms

By accessing or using the Bingomatic Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any future amendments and any additional guidelines or rules applicable to specific services, which may be posted from time to time.

2. Description of Service

Bingomatic provides AI-hosted virtual bingo game rooms where players can join and play bingo online. Our Service includes, but is not limited to, real-time bingo games with AI-powered hosts, browser-based gameplay, audio streaming of number calls, and the ability for users to host their own rooms using the standalone agent plugin. The Service is provided free of charge to players.

3. User Conduct

3.1 General Conduct

You agree to use the Service in a manner consistent with all applicable laws and regulations. You are solely responsible for your conduct while using the Service.

3.2 Prohibited Uses

Prohibited uses include, but are not limited to:

  • Cheating: Attempting to manipulate game outcomes, exploit bugs, or use automated tools to gain unfair advantages
  • Harassment: Engaging in any form of harassment, abuse, or threatening behavior toward other players or hosts
  • Impersonation: Impersonating any person or entity, or falsely representing your affiliation
  • Interference: Interfering with or disrupting the Service, servers, or networks connected to the Service
  • Malware: Uploading or transmitting viruses, worms, or any items of a destructive nature
  • Data Mining: Using any automated means to access, retrieve, scrape, or index any portion of the Service

4. Agent Plugin and Room Hosting

4.1 Third-Party API Keys

The Bingomatic standalone agent plugin requires a Google Gemini API key provided by you. You are responsible for your own API usage and any associated costs. We do not store or have access to your API keys.

4.2 Host Responsibilities

If you host a bingo room using the agent plugin, you are responsible for the content generated by your configured AI host. You agree not to configure the agent to produce harmful, offensive, or illegal content.

5. Privacy Policy

Your privacy is important to us. Please refer to our Privacy Policy, which explains how we collect, use, and disclose information. By using the Service, you agree to our collection, use, and disclosure of your information as described in our Privacy Policy.

6. Intellectual Property

6.1 Bingomatic's Intellectual Property

All rights, title, and interest in and to the Service, including all intellectual property rights, are and will remain the exclusive property of Bingomatic and its licensors. The Service is protected by copyright, trademark, and other laws. Nothing in these Terms gives you a right to use the Bingomatic name or any of the Bingomatic trademarks, logos, domain names, and other distinctive brand features.

6.2 Open Source

The Bingomatic standalone agent plugin is distributed under the MIT License. The platform source code may contain components licensed under various open-source licenses.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, BINGOMATIC EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. BINGOMATIC MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BINGOMATIC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Chicago, Illinois, in accordance with the Streamlined Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS") then in effect.
